Welcome to Kikstart Rehabilitation. By accessing or using our website and services (collectively, the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, please do not use our Services.

This document is a written binding agreement and an electronic record under the Information Technology Act, 2000, and the applicable rules. It is published in accordance with Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011. A computer system generates this electronic record and does not require any physical or digital signatures.

A. General Information

1.    About Kikstart Rehabilitation

Kikstart Rehabilitation is a platform that provides online therapy support, training, and resources for individuals with visible and invisible disabilities and their families. We connect users with professional therapists and offer support online and offline training and resources.

2.    Disclaimer:

2.1 Online therapy is not advisable if you are in acute distress. Please contact your nearest hospital if you are feeling suicidal or at risk of self-harm. We can assist you with this.

2.2 At Kikstart Rehabilitation, we carefully evaluate the client’s fit for online services by offering free fifteen minutes of professional consultation to understand the therapy process, kikstart terms and conditions, & policies.

2.3 We make every effort to ensure the information provided on our website, including blogs, is accurate; however, we cannot guarantee its reliability, currency, or completeness. The content is intended for general knowledge only and should not be used as a substitute for professional medical advice, diagnosis, or treatment.

2.4 Our Site may contain links to third-party websites and advertisements. We are not responsible for the content or practices of these external sites, and you use them at your own risk.

2.5 In compliance with applicable Indian laws, including the Information Technology Act, 2000 and Copyright Amendment Act, 2012, Kikstart Rehabilitation, as an online service provider and intermediary, reserves the right to remove or disable access to any material that we are notified of or believe in good faith violates these laws or infringes someone’s copyright. At our sole discretion, we may delete, remove, disable access, or otherwise manage your information and data on our platform to ensure compliance with these legal obligations.

3.    Confidentiality

3.1 Upon accessing services, the user is entitled to protect confidential information shared during sessions. Our platform is a safe space, and the right to confidentiality is an integral part of this safe space. The interactions between users and our professionals constitute privileged information, meaning that the contents of these interactions are not revealed to anybody.

3.2 All professionals at Kikstart Rehabilitation are bound by confidentiality rules. All administrative staff handling client information have been trained to protect user information and are bound by confidentiality rules.

3.3 Limitations to confidentiality include:

  1. Information disclosure in cases of imminent danger to self/others: When there is evidence of threat or harm to self or others, professionals must disclose such information to the emergency Contact shared by the client and/or law enforcement agencies to help prevent loss of life.
  2. Disclosure to a nominated representative (if applicable).
  3. Disclosure to statutory authorities: In the rare event that a statutory authority like the High Court/Supreme Court/ Board or other authorities warrant disclosure of privileged information to ascertain the client’s mental or physical status.
  4. Disclosure of information to other healthcare providers: This includes psychiatrists, GPs, paediatricians, other specialists, etc., to inform and facilitate treatment.
  5. Disclosure in the interest of public safety and security: Only relevant information to safeguard life will be shared with legal authorities if the contingency arises. Every attempt will be made to discuss the disclosure step with the client before the emergency contact.

Our confidentiality policy is based on relevant healthcare legislation and is subject to change to reflect legislation and/or policy changes.

B. Use of the Service

1.    Eligibility

Using our Service, you confirm that you are of legal age in your state or province of residence or have obtained parental consent for any minor dependents using the Site.

2.    Prohibited Uses

You agree not to use the Service for any unlawful or unauthorised purposes. This includes transmitting harmful code or violating any laws. Breaching these terms may result in immediate termination of your access to the Service.

3.    User Conduct

You agree to provide accurate information and not to impersonate others or use the service in a way that could damage, disable, or impair our Site. Interfering with other users’ enjoyment of the Service is prohibited.

C. Services

1.    Booking and Payment

To use our Service, you must book a consultation and provide accurate information. Payment terms and fees will be communicated during the booking process.

1.1. Session Fees

  1. When a client books a session with Kikstart Rehabilitation, the client will pay the service fees as the healthcare professional has informed them (the “Session Fees”) following our pricing policy. Once the Session fees are paid, a confirmation email and a WhatsApp message will be sent to the client.
  2. If the client’s payment method is rejected or cancelled, the booking will not be reserved and will automatically expire. The session fees paid by clients through Kikstart Rehabilitation constitute the entire amount payable for the sessions. Therapists shall not charge clients any additional fees.
  3. We reserve the right to modify fees at our discretion. Any changes, updates, or fee adjustments will take effect immediately once posted on our website or notified. For clients currently enrolled in a service package, the revised fees will apply after completing their existing package. Clients will be informed of any changes in session charges via email and WhatsApp.
  4. You will receive invoices for the session fees you paid via email. You can review and download them.

1.2  Payment Processing

  1. Payments for Kikstart Rehabilitation services, including session fees and refunds, are accepted through card payment facilities, online bank transfers, and wallet payments.
  2. Kikstart Rehabilitation is not liable for payments that fail to reach us due to incorrect payment details you provided or if the payment processor rejects the transaction.
  3. The payment processor may collect personal data from you, such as your name, credit card details, payment account information, or other necessary data, to process your payments.
  4. The payment processor manages all aspects of the payment process, including data collection and processing.
  5. Transactions using valid credit/debit/cash cards, online bank transfers, and other payment methods are processed through a secure payment gateway or appropriate infrastructure.
  6. These transactions are governed by terms agreed upon between users and their respective banks or payment issuers.
  7. Kikstart Rehabilitation assumes no liability for unauthorised use, fraud, payment refunds, or lost funds resulting from such transactions.

1.3 Free Consultation

Each client is entitled to a single free consultation, which they may choose to opt for, with our consultant before choosing a therapist. Such consultations are limited to fifteen minutes and do not substitute the sessions.

2. Cancellation and Rescheduling

To cancel or reschedule a session, notify us at least 90 minutes before the scheduled time. You may be eligible for a refund or rescheduling if done within this timeframe. Similar terms will apply if we need to cancel or reschedule, and you will be informed promptly. Refer to our cancellation policies for detailed information.

D. Intellectual Property

1.    Copyright

All content on our Site, including text, graphics, logos, images, and software, is the property of Kikstart Rehabilitation or its content suppliers and is protected by international copyright laws. You may not use, reproduce, or distribute any content without our written consent.

2.    Trademarks

The trademarks, service marks, and logos displayed on our Site are the property of Kikstart Rehabilitation. You are not granted any license or right to use any trademarks without our prior written permission.

E. Sale of Assets, Merger, Acquisition

For internal purposes, Kikstart Rehabilitation may share your information with our parent company, subsidiaries, and affiliates. Additionally, we reserve the right to disclose and transfer your information in the following circumstances:

  1. To a subsequent owner, co-owner, or operator of our website or relevant database.
  2. In connection with a corporate merger, consolidation, restructuring, the sale of all our membership interests and/or assets, or any other corporate change, including during any due diligence process.
  3. In the event of a change in ownership, you will be notified via email and/or a prominent notice on our website.

F. Limitation of Liability

Kikstart Rehabilitation and its affiliates, officers, employees, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, arising from your use of the Service.

G. Indemnification

You agree to indemnify and hold harmless Kikstart Rehabilitation and its affiliates, directors, employees, agents, licensors, suppliers, and any third-party information providers from any claims, losses, expenses, damages, and costs, including attorneys’ fees resulting from your use of the site or violation of these Terms.

H.Violation of Terms and Conditions

1.    Termination of Access

If you violate these Terms of Use or our published policies, your right to use or access the Services will be automatically revoked. Kikstart Rehabilitation reserves the right, at our sole discretion, to terminate your access to all or part of our Services, for any reason, with or without notice.

2.    Legal Consequences

Violating these Terms of Use constitutes a breach of your agreement with Kikstart Rehabilitation and may infringe upon the intellectual property, unfair competition, and other applicable laws. We take such violations seriously and will enforce our rights to the fullest extent permitted by law.

I. Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the Republic of India without regard to its conflicts of law provisions.

1.    Jurisdiction

For all purposes related to these Terms (including other terms and policies referred herein), the parties agree to submit to the exclusive jurisdiction of the courts located in Maharashtra,  Republic of India. Each party irrevocably consents to the jurisdiction of such courts (and of the appropriate appellate courts) in any such legal action or proceeding and waives any objection to the laying of venue in any such court or that any legal action or proceeding has been brought in an inconvenient forum. Process in any legal action or proceeding may be served on any party anywhere in the world, whether within or outside the jurisdiction of any such court.
